The Individuals with Disabilities Education Act (IDEA) ensures that all children with disabilities receive a “free appropriate public education”(FAPE.) In a brand new court decision, Forest Grove School District v. T.A., the Supreme Court ruled in favor of Oregon parents of a teenager with ADHD. The Court decided that IDEA authorizes reimbursement for private special-education services when a public school fails to provide a FAPE and the private school placement is appropriate, whether or not the child previously received special-education services through the public school.
Parents, do you have a good understanding of what a FAPE is?
How do you go about finding out whether your child is receiving FAPE from his or her school?
